Limited Divorce:
A limited divorce, sometimes referred to as
a separation, puts the court in charge of
supervising a couple’s separation. Limited
divorce is sought when grounds for an
absolute divorce have not been met. There
may be problems between the couple with
finances or resolving conflicts in private.
During a limited divorce, the courts will
decide who is at fault and rule on support,
custody, asset division and other pertinent
issues.
Parties live apart during this process but
remain husband and wife. They are not free
to remarry or become sexually involved with
other persons.
To obtain a limited divorce, a spouse must
first prove grounds. Grounds for a limited
divorce include: cruelty or vicious
treatment to parent or child, excessive
conduct, desertion and voluntary separation
with no hopes of reuniting.
