Collaborative Law and Divorce
Collaborative law is a method of dispute
resolution where the attorneys of both
spouses help the spouses in resolving
their conflicts or legal issues without
going through traditional court
proceedings. Collaborative law is for
spouses who want to avoid litigation but
still need legal representation. In
this process, the couple and attorneys
agree not litigate. If the couple
decides to proceed with litigation then
their attorneys must withdraw from the
case. This method generally takes less
time and is less expensive than a
traditional divorce. In addition, this
method may allow for you to obtain some
divorce professionals such as, financial
specialists, counselors and divorce
coaches.
The goal of collaborative law is to work
towards a mutual settlement agreement.
To start this process each of the
spouses will meet with their respective
attorneys. Each spouse will explain to
their attorney their situation and
expectations. Then, both spouses and
their attorneys will go through
discussions and conferences in order to
reach a settlement agreement. Both
spouses must exchange all relevant
information pertinent for a settlement
agreement to the other party. If there
is a need for experts, they will be
jointly retained. When the parties
reach a settlement agreement it will be
filed with court, if needed, by the
state.
