Alimony
Alimony is maintenance (spousal support)
an individual pays to their former
spouse. Maintenance is often awarded by
the courts at the discretion of the
judge. Each state has their own rules
and methods regarding maintenance
payments. It is generally given to the
spouse, regardless of sex, who has
become economically dependent on the
other spouse during a lengthy marriage.
Maintenance is often not awarded to
those in short term marriages or if both
parties are employed and easily
independent of the other.
Below are some determining factors in
deciding if and how much maintenance
should be awarded including:
·
Length of marriage
·
Physical and emotional health of spouses
·
Age of each spouse
·
Educational level/vocational skills of
each spouse
·
Agreements made prior to marriage
·
Conduct during the marriage
·
Reasons for divorce
·
Standard of living prior to the
separation/divorce
·
Current income and earning potential of
spouses
·
Current assets and debts
·
Contribution of spouse as homemaker
